Acceptance of Terms

By accessing or using TestMax ("the Service"), operated at test-max.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. We may update these Terms from time to time, and your continued use of TestMax constitutes acceptance of any changes.

Description of Service

TestMax is an online trading backtesting platform that replays real historical market data candle-by-candle. Users can practice placing trades, test strategies on futures instruments (including NQ, ES, and CL), and track performance through analytics.

TestMax is not a broker, financial advisor, or investment service. The platform is strictly an educational and practice tool. Nothing on TestMax constitutes financial advice, and past performance in backtesting does not guarantee future trading results.

Account Registration

To use TestMax, you must create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete registration information
• Keep your password secure and not share it with others
• Notify us immediately if you suspect unauthorized access to your account
• Not create multiple accounts to circumvent plan limits

Free and Pro Plans

TestMax offers a free plan with limited features and a Pro plan with expanded capabilities. Free accounts have access to the last 4 months of market data, basic charting, and core analytics. Pro accounts unlock unlimited historical data, Prop Firm Challenge Mode, Algo Playground, and additional features as described on our Pricing page.

We reserve the right to modify plan features, pricing, and availability at any time. Material changes to paid plans will be communicated to affected subscribers in advance.

Payment and Billing

All payments for the Pro plan are processed through our payment provider, Dodo Payments. By subscribing to a paid plan, you agree to the following:

• Subscriptions are billed on a recurring basis (monthly or annually, depending on the plan selected)
• You authorize Dodo Payments to charge your payment method on each billing cycle
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• Refunds are handled on a case-by-case basis; contact support for refund requests

Acceptable Use

You agree to use TestMax only for its intended purpose as a trading practice and backtesting tool. The following activities are strictly prohibited:

• Scraping, crawling, or programmatically extracting data from the platform without authorization
• Redistributing, reselling, or sublicensing market data provided through TestMax
• Using TestMax to facilitate, plan, or execute any form of market manipulation
• Attempting to reverse-engineer, decompile, or disassemble the platform
• Interfering with the operation of the Service, including overloading servers or exploiting vulnerabilities
• Using the Service for any unlawful purpose or in violation of applicable regulations

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

Intellectual Property

All content, code, designs, trademarks, and other intellectual property on TestMax are owned by TestMax or its licensors. You retain ownership of any data you create on the platform (such as trading sessions and notes). You may not copy, modify, distribute, or create derivative works from our platform without explicit written permission.

Disclaimer

TestMax is provided "as is" and "as available" without warranties of any kind, either express or implied. Specifically:

• TestMax does not provide financial, investment, or trading advice
• All data displayed on the platform is historical and for educational purposes only
• Backtesting results are based on historical data and do not guarantee future performance in live markets
• We do not guarantee the accuracy, completeness, or reliability of any market data presented
• We make no warranties regarding the uninterrupted availability of the Service

You acknowledge that trading involves substantial risk of loss and that you are solely responsible for your own trading decisions.

Limitation of Liability

To the maximum extent permitted by law, TestMax and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, trading losses, data loss, or other intangible losses arising from your use of or inability to use the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid to TestMax in the 12 months preceding the claim.

Termination

We may suspend or terminate your access to TestMax at any time, with or without cause, including for violation of these Terms. You may also delete your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and intellectual property) will remain in effect.

Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or your use of TestMax shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.

Changes to Terms

We may revise these Terms at any time by updating this page. Material changes will be communicated via email or a prominent notice on the platform. The "Last updated" date at the top of this page indicates when the Terms were last modified. Your continued use of TestMax after changes are posted constitutes your acceptance of the revised Terms.
